Election Commission Competent To Answer Succession Questions

The High Representative and EU Special Representative Miroslav Lajčák welcomes tomorrow’s (Thursday) meeting between the BiH Election Commission and the RS authorities in Banja Luka to discuss matters related to filling the post of RS President.

In the absence of clear constitutional and legal provisions questions have arisen over how the post of RS President should be filled following the untimely death of RS President, Milan Jelic.

The Republika Srpska National Assembly Decision of 1 October 2007 authorizing RSNA Speaker Igor Radojicic to execute certain tasks that that would otherwise fall under the competencies of the RS President has created some concerns.

It has been suggested that this decision undermines the basic democratic principle of the separation of powers, the position of RS vice-presidents and the Election Law of Bosnia-Herzegovina specifically.

“These open questions need to be resolved properly. The BiH Election Commission is competent to give answers to some of these questions,” said the HR/EUSR today. “I will follow developments closely,” he added.
